1. Definitions

• “Smart Drivers” refers to the driving school providing tuition services.
• “Learner” refers to any individual booking or receiving driving lessons with Smart Drivers.
• “Lesson” refers to any scheduled driving instruction session provided by Smart Drivers.
• “Booking” refers to a confirmed reservation for a driving lesson.

2. Eligibility

2.1 Learners must hold a valid provisional driving licence appropriate for driving in Gibraltar.
2.2 Learners must meet the minimum legal age requirements under Gibraltar road traffic legislation.
2.3 Smart Drivers reserves the right to refuse or discontinue tuition if the Learner is not legally permitted to drive.

3. Bookings

3.1 All lessons must be booked in advance and are subject to instructor availability.
3.2 A booking is only confirmed once it has been accepted by Smart Drivers.
3.3 Smart Drivers reserves the right to assign or change instructors, vehicles, or lesson times where necessary, including operational requirements.

4. Payments

4.1 Full or partial payment may be required at the time of booking, unless otherwise agreed in writing.
4.2 Smart Drivers reserves the right to withhold or cancel lessons where payment has not been received.
4.3 All prices are subject to change; however, confirmed and paid bookings will not be affected.

5. Cancellations and Rescheduling

5.1 Learners must provide at least 48 hours’ notice to cancel or reschedule a lesson.
5.2 Cancellations made with less than 48 hours’ notice will be charged in full.
5.3 Failure to attend a scheduled lesson (no-show) will result in the full lesson fee being charged.
5.4 Smart Drivers reserves the right to cancel or reschedule lessons due to circumstances beyond its control, including but not limited to weather conditions, vehicle issues, or instructor unavailability.

6. Punctuality

6.1 Learners must be ready at the agreed time and location.
6.2 Late arrival may result in a reduced lesson duration without refund, at the discretion of the instructor.

7. Learner Conduct and Responsibilities

7.1 Learners must behave in a respectful, cooperative, and safe manner at all times.
7.2 Lessons must not be attended under the influence of alcohol, drugs, or any impairing substances.
7.3 Learners must inform Smart Drivers of any medical condition or circumstance that may affect their ability to drive safely.

8. Instructor Authority

8.1 The instructor has full control of the vehicle during all lessons.
8.2 The instructor may terminate a lesson immediately, without refund, if the Learner behaves dangerously, unlawfully, or in a manner that compromises safety.
8.3 The instructor may refuse to continue a lesson where safety is reasonably in doubt.

9. Vehicle Use

9.1 All lessons are conducted in dual-controlled vehicles insured for driving instruction.
9.2 Learners must not interfere with vehicle controls unless instructed by the instructor.

10. Liability

10.1 Smart Drivers shall not be liable for any loss, damage, or injury arising from circumstances beyond its reasonable control.
10.2 Nothing in these Terms excludes liability for death or personal injury caused by negligence where such exclusion is prohibited by law.

11. Driving Tests (if applicable)

11.1 Smart Drivers does not guarantee driving test availability, dates, or outcomes.
11.2 Use of a Smart Drivers vehicle for driving tests is subject to availability and may require separate booking and fees.

12. Data Protection

12.1 Smart Drivers will collect and process personal data in accordance with applicable Gibraltar data protection laws and relevant GDPR principles.
12.2 Data will only be used for administration, lesson scheduling, communication, and legal obligations.

13. Complaints

13.1 Any concerns or complaints should be raised with Smart Drivers at the earliest opportunity.
13.2 Smart Drivers will aim to address and resolve all complaints fairly and promptly.

14. Governing Law

14.1 These Terms and Conditions are governed by the laws of Gibraltar.
14.2 Any disputes shall fall under the exclusive jurisdiction of the courts of Gibraltar.

15. Amendments

15.1 Smart Drivers reserves the right to amend these Terms and Conditions at any time.
15.2 The version in force at the time of booking will apply to that booking.
